The brokerage contract between the customer and the company HomE² - real estate and more! GmbH & Co. KG comes about either through a written agreement or through the use of our brokerage activities on the basis of or with knowledge of the commission claim incurred for the successful mediation or verification activity.

Our offers and communications are intended exclusively for the recipient (hereinafter also referred to as 'customer' or 'interested party') of the present exposé and must therefore be treated as confidential. It is not permitted to make the property information accessible to third parties or to transmit it to them. If a contract of any kind is concluded as a result of the unauthorized disclosure of the data and information available here, the customer is obliged to pay us corresponding damages in the amount of the commission that would have been incurred in the event of success.

If the recipient of the exposé or offer/object is already aware of the opportunity to conclude a contract that we have demonstrated, he must inform us of this in writing immediately, but no later than within a period of 3 calendar days, and provide evidence upon request. If no notification is made, our activity is at least partly responsible for the success and justifies the obligation to pay a commission to us.

Our commission within the meaning of § 652 Paragraph 1 BGB arises for the mediation or proof of an object or a purchase and is due upon conclusion of the notarial contract or the conclusion of another contract in this matter (e.g. rental or lease contract). The customer is obliged to inform us immediately when, for what fee and with which parties the main or notary contract was concluded. This obligation to provide information is not affected by the fact that the main contract is subject to a condition precedent and this has not yet occurred.

A claim for commission also arises if the contract is concluded under conditions that deviate from the offer or the desired economic success or purpose is achieved through a contract for another object of the contractual partner proven by us; Finally, if and to the extent that contractual extensions and supplements come about in temporal and economic connection with a first contract.

The commission claim also arises with purchase and rental or vice versa, heritable building rights instead of purchase as well as with acquisition through foreclosure. The entitlement to commission also remains if the concluded contract is canceled or declared null and void as a result of contestation or for any other legal reason.

In this case, the contracting party is obliged to pay the total commission that is the reason for the cancellation of the contract. The commission charged by us is based on the local and market rates, as recognized, for example, by the broker organized in the real estate association, unless otherwise agreed. The confirmation of a proven object, inquiries with us or the start of negotiations, inspections, etc. with us are considered acceptance of our terms and conditions.

Should individual provisions of these terms and conditions be wholly or partially - for whatever reason - legally invalid or not or not fully enforceable, this shall not affect the validity of the remaining provisions. In their place, an appropriate regulation should apply that comes closest to the intended and economic goal.

Retention or offsetting against a commission claim are only possible if the customer's claims are based on the same contractual relationship (brokerage contract) or if other claims are undisputed or legally binding.

The object information is based on the contract-related information communicated to us and known to us. We can therefore not assume any liability whatsoever for the correctness and completeness of the information. All data, photos and text contributions created by us are protected by copyright. The duplication of information or data, in particular the use of texts, parts of text, images, requires the prior written consent of HomE² - Immobilien und mehr! GmbH & Co. KG.

The information contained in the exposé is based exclusively on information provided by the seller, the findings during the inspection appointment and information from authorities or other third parties.

HomE² - real estate and more! GmbH & Co. KG assumes no liability for the correctness and completeness of the information contained in the exposé.

The liability of HomE² real estate and more! GmbH & Co. KG is limited to grossly negligent and willful conduct, provided that the breach of duty does not lead to injury to life, limb or health of the customer.

The present General Terms and Conditions apply on German territory, throughout the EU as well as in Switzerland and also for foreign prospective buyers and tenants to whom we can prove that they have bought or rented an object.

Place of performance and place of jurisdiction is the seat of HomE² -IMMOBILIEN and more! GmbH & Co. KG. German law applies to the contractual relationship.

The agreement on the place of jurisdiction also applies to customers who carry out a comparable commercial activity abroad, as well as to foreign institutions that are comparable to domestic legal entities under public law or a domestic special fund under public law.

Should one or more provisions be wholly or partially invalid, this shall not affect the validity of the remaining provisions. The ineffective provisions shall be replaced retrospectively by a provision that is as similar in content as possible and comes as close as possible to the purpose of the intended provision.

Cancellation policy for consumers - right of cancellation

You have the right to revoke your contract declaration within a period of 14 days in text form (letter, e-mail, fax) without giving reasons. The cancellation period begins after receipt of this instruction, but not before the conclusion of the contract and not before the fulfillment of the information obligations. inform you of your decision to withdraw from this contract by means of a clear statement.

You can use the attached sample revocation form, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

Consequences of the revocation:

If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (except for the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract.

For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you. Under no circumstances will you be charged any fees for this repayment.

If you have been requested that the services are to begin during the cancellation period, we can demand a reasonable amount, which corresponds to the proportion of the services already provided up to the point in time at which you informed us of the exercise of the right of cancellation with regard to this contract compared to the total scope of the services provided for in the contract.

Reference to the possibility of premature expiration of the right of withdrawal

Your right of revocation expires prematurely if we have provided our service in full or if the contract has been completely fulfilled by both parties at your express request before you have exercised your right of revocation.
